This policy does not, however, govern the terms of our relationship or constitute any representation or warranty. The terms of our relationship are governed by our Terms and Conditions. The terms “the Winery,” “Site,” “us” or “we” refer to Shafer Vineyards and/or its subsidiaries or affiliates, including all wineries and brands owned and operated thereby (“Affiliates”), and this website.

The terms “you”, “your” or “customer” refer to the user or viewer of this Site or customer of the Winery. Please read this privacy policy carefully. If you do not agree to our practices, please do not register, subscribe, create an account, make purchases or otherwise interact with this Site. By visiting and using the features on the Site (including creating an account, mailing list sign up, membership sign up, making a tasting reservation and browsing), or by providing us with your personal information, you agree to this privacy policy.

We are based in California, and this policy incorporates protections for California residents provided under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (“CCPA”). Since we care about your privacy, we provide the same rights to all of our customers whether or not they are California residents. This privacy policy applies when you visit the Site, and any mobile sites or mobile applications we may provide; when you make a purchase from us; when you subscribe to any of our mailing lists including text and email, newsletters, or membership programs; sign up for our tastings or events; or otherwise when you interact with us and provide us with your personal information.

We use Tock to facilitate scheduling of tasting appointments. When you make a reservation through Tock, you further agree to Tock’s terms of use and privacy policy as referenced on the Tock reservation platform.

Why We Collect Your Information

AGE VERIFICATION

You must be of legal age to use the Site or purchase wine. We may require proof of age and a legal delivery address. We do not knowingly collect or sell information from individuals under 21.

TRANSACTIONS

We are required to collect and share your information with Service Providers (e.g., shipping, billing, reservations) to process orders, shipments, and memberships.

ADVERTISING AND MARKETING

We use collected information for advertising and marketing, but do not sell it to third parties. We may share with third parties (such as ad providers) to facilitate marketing. You may opt out by contacting us, updating preferences, unsubscribing, or replying STOP to texts. Transactional messages may still be sent.

How Long We Keep Your Information

We retain your information as long as your account is active or required for legal/financial compliance. Order history is kept indefinitely unless you request deletion.

Your Rights to Access, Delete or Correct Your Data

You may request copies, corrections, or deletions of your data, up to twice per year. Verification may be required. Requests can be made via info@shafervineyards.com, by phone at 707-944-2877, or by mail (Shafer Vineyards, ATTN: CCPA Requests, 6154 Silverado Trail, Napa CA 94885). We will respond within 45 days.

If deletion prevents us from maintaining proof of your legal age or location where sales are permitted, we may be unable to sell you alcoholic beverages unless other verification arrangements are made.

Protecting Your Information

We use firewalls, tokenization for sensitive data (e.g., credit cards), and restricted employee access. While we and our processors maintain security controls, no internet transmission or storage is 100% secure; use of the Site is at your own risk.

How We Share Your Information With Third Parties and Service Providers

We do not sell or rent personal information to any Third Party for that Third Party’s marketing purposes. We work with Service Providers (shipping companies, data hosts, credit card processors, reservation management such as Tock, email management platforms) to fulfill services. They must keep your data confidential and use it only to provide services for us and you. We may disclose non-personal information (e.g., traffic patterns) for site operation. We may share limited data with marketing/analytics providers; you can opt out as described above.

Cookies

We use cookies to improve navigation, remember information you provide, and tailor content. You can manage cookies in your browser settings or via controls on our site. Do Not Track Signals/Global Privacy Control

The Site does not respond to browser “Do Not Track” signals. The Site does respond to Global Privacy Control signals as a Do Not Sell/Share request for data automatically collected by the Site.

Gift Recipients

If you send a gift from our Site, we collect recipient contact information (name, shipping address, phone, email) to ensure delivery and verify legal age when alcohol is included. Gift recipients have the same privacy rights as customers and can opt out of emails by contacting info@shafervineyards.com.

Data of Minors

The Site is not directed at children and requires age verification to access. We do not knowingly collect, sell, or share personal information of individuals under 16.
